Terms of Service

The agreement that governs access to and use of Skybolt's talent profiles, agency tools, casting systems, and AI features.

These Terms of Service (“Terms”) govern access to and use of the websites, applications, software, talent profiles, casting systems, artificial-intelligence features, communication systems, and other services operated by Skybolt (“Skybolt,” “we,” “us,” or “our”), collectively referred to as the “Services.”

By creating an account, purchasing a subscription, or using the Services, you agree to these Terms and the Skybolt Privacy Policy.

If you do not agree, do not use the Services.

1. Skybolt

Skybolt provides technology designed to connect and support talent, talent agents and managers, casting professionals, and other entertainment-industry professionals.

The Services may include:

  • Professional talent profiles
  • Photographs, digitals, video, audio, and media
  • Résumés and professional information
  • Agency roster management
  • Talent search
  • Casting projects
  • Agency submissions
  • Auditions and callbacks
  • Talent selections
  • Communication tools
  • Email and SMS notifications
  • Casting workflow tools
  • Artificial-intelligence features
  • Subscription and account-management tools
  • Other related functionality

Skybolt may add, modify, or discontinue features as the Services evolve.

2. Skybolt Is a Technology Platform

Skybolt provides software and related technology.

Unless expressly agreed otherwise in writing, Skybolt is not acting as:

  • A talent agent
  • Talent manager
  • Casting director
  • Producer
  • Production company
  • Employer
  • Employment agency
  • Legal representative

Skybolt does not make hiring, representation, casting, or employment decisions on behalf of users.

Use of Skybolt does not guarantee:

  • Representation
  • Auditions
  • Callbacks
  • Bookings
  • Employment
  • Compensation
  • Casting
  • Professional opportunities
  • Any particular professional result

3. Accounts

Users must provide accurate and reasonably current information.

You are responsible for:

  • Protecting your account credentials
  • Activity performed through your account
  • Maintaining accurate contact information
  • Using the Services lawfully
  • Promptly notifying Skybolt of unauthorized access

You may not access another user's account without permission.

Skybolt may require verification of identity, account ownership, or authority.

4. Talent Accounts and Profiles

Talent may enter and maintain their own profile information through Skybolt.

Profiles may contain information including:

  • Name or stage name
  • Photographs
  • Video
  • Audio
  • Résumé
  • Professional credits
  • Experience
  • Skills
  • Measurements
  • Physical characteristics
  • Casting characteristics
  • Availability
  • Agency information
  • Other professional information

Talent are responsible for keeping their information reasonably accurate and current.

5. Public Profiles

Skybolt talent profiles are professional profiles designed to help talent be represented, discovered, submitted, and considered for entertainment-industry opportunities.

Certain profile information may be accessible to:

  • The general public
  • Talent agents
  • Managers
  • Casting professionals
  • Producers
  • Clients
  • Other entertainment-industry participants

Information intended for professional display may include photographs, video, audio, résumé information, measurements, skills, appearance information, experience, and similar professional information.

Private account and contact information is not intended to be displayed as part of the public professional profile.

Users should only place information in public-facing profile fields that they are comfortable making available to others.

6. Casting Search and Submissions

Casting professionals may be able to:

  • Search available professional talent profiles
  • Filter talent using casting criteria
  • View professional profile information
  • Receive talent submitted by agencies
  • Manage casting projects
  • Review submissions
  • Manage callbacks and selections
  • Communicate with agencies or other authorized users

Agents may also submit talent directly to casting professionals, clients, or other industry participants.

Skybolt does not guarantee the identity, qualifications, conduct, legitimacy, or intentions of every person who may view professionally available information.

Users are responsible for exercising appropriate professional judgment when interacting with other users.

7. Minor Talent

A person under 18 may not independently create or control a Skybolt account.

A parent or legal guardian must create and manage the account for talent under 18.

By creating or managing a profile for a minor, the parent or legal guardian represents that they have authority to:

  • Create the account
  • Provide the minor's information to Skybolt
  • Upload photographs, videos, audio, and other media
  • Permit professional profile information to be displayed
  • Permit agents and casting professionals to access appropriate profile information
  • Authorize professional submissions
  • Authorize Skybolt to process the information as described in the Privacy Policy

Parents and guardians are responsible for supervising use of the Services by minor talent.

Skybolt may require additional verification or parental authorization where required by law.

8. User Content

“User Content” means photographs, video, audio, résumés, documents, text, messages, profile information, and other content uploaded or provided through Skybolt.

You retain any ownership rights you have in your User Content.

You understand that some User Content may also be subject to rights belonging to photographers, videographers, production companies, agencies, licensors, or other persons.

You represent that you possess the rights and permissions necessary to upload and use User Content through Skybolt.

9. License to Operate Skybolt

By uploading User Content, you grant Skybolt a nonexclusive, worldwide, royalty-free license to host, store, copy, reproduce, resize, convert, transmit, display, process, analyze, and otherwise use the content as reasonably necessary to:

  • Operate the Services
  • Maintain talent profiles
  • Display professional profiles
  • Facilitate talent searches
  • Facilitate representation
  • Make authorized submissions
  • Operate casting tools
  • Provide communications
  • Provide artificial-intelligence features
  • Maintain security and backups
  • Provide technical support
  • Deliver functionality requested by authorized users

This license does not transfer ownership of User Content to Skybolt.

The license continues as long as reasonably necessary to operate the Services and maintain legally or operationally necessary records and backups.

10. Artificial Intelligence Features

Skybolt may provide artificial-intelligence features intended to assist agents, talent, casting professionals, or other authorized users.

Skybolt currently uses Google Gemini and MCP-based technology in connection with its AI assistant.

To provide these features, Skybolt's AI systems may process talent information including:

  • Profile data
  • Résumé information
  • Skills
  • Measurements
  • Professional information
  • Photographs
  • Uploaded media
  • Other information available within the user's profile or relevant Skybolt systems

The AI assistant may use this information to:

  • Answer questions
  • Search for talent
  • Summarize information
  • Organize information
  • Assist agents
  • Recommend or identify potentially relevant profiles based on requested criteria
  • Perform other authorized tasks within Skybolt

By using Skybolt, you authorize this processing as described in the Privacy Policy and subject to applicable law.

AI Output May Be Wrong

Artificial-intelligence output may:

  • Contain errors
  • Misinterpret information
  • Omit relevant information
  • Produce inaccurate results

Users are responsible for reviewing AI-generated information before relying on it for professional decisions.

Skybolt does not guarantee the accuracy, completeness, or suitability of AI-generated output.

AI functionality is intended as an assistive tool and does not guarantee casting, representation, hiring, or any other outcome.

11. Content Rules

You may not upload, submit, or transmit content that:

  • Violates applicable law
  • Infringes intellectual-property rights
  • Violates privacy or publicity rights
  • Is intentionally fraudulent
  • Contains malicious software
  • Exploits or endangers a minor
  • Constitutes unlawful harassment or threats
  • Contains unlawful sexual material
  • Is provided without necessary authorization
  • Threatens the security or lawful operation of Skybolt

Skybolt may remove, restrict, or disable content that violates these Terms.

12. Acceptable Use

You may not:

  • Gain unauthorized access to Skybolt systems
  • Access another person's account without permission
  • Circumvent account permissions
  • Scrape or systematically extract Skybolt data without authorization
  • Harvest talent information
  • Harvest private contact information
  • Use unauthorized automated bots
  • Reverse engineer Skybolt except where prohibited from restricting that activity by law
  • Interfere with the operation or security of the Services
  • Introduce malware
  • Send unlawful spam
  • Impersonate another person
  • Use Skybolt for stalking or harassment
  • Use information obtained from Skybolt for unlawful discrimination
  • Resell access to Skybolt without authorization
  • Use Skybolt data to create or maintain a competing database or service without written permission

13. Intellectual Property

Skybolt's software, systems, user interfaces, designs, databases, trademarks, logos, and other proprietary technology are owned by or licensed to Skybolt.

Except for the rights expressly provided in these Terms, you receive no ownership interest in Skybolt's technology or intellectual property.

You may not reproduce, copy, modify, distribute, sell, license, or commercially exploit Skybolt's proprietary technology without authorization.

The Skybolt name and associated marks may not be used without permission.

14. Confidential Information

Users may receive access to confidential information belonging to Skybolt, an agency, talent, casting professional, or another user.

You agree to use genuinely confidential information only for authorized purposes.

Confidential information does not include information that:

  • Is publicly available through no violation of these Terms
  • Was lawfully known without confidentiality restrictions
  • Is independently developed
  • Is lawfully received from another source
  • Must legally be disclosed

Nothing in this section prohibits lawful competition or discussion of information that is not confidential.

15. Subscription Billing

Skybolt charges talent directly for paid subscriptions.

Payments are processed through Stripe.

The price and billing interval applicable to your subscription will be displayed when you subscribe.

By purchasing an automatically renewing subscription, you authorize Skybolt and Stripe to charge the payment method associated with your account at the applicable recurring interval until you cancel.

Skybolt does not offer a free trial unless expressly stated otherwise in connection with a future offer.

16. Automatic Renewal

Skybolt subscriptions automatically renew until canceled.

Before purchasing an automatically renewing subscription, users will be provided the applicable:

  • Price
  • Billing frequency
  • Automatic-renewal terms
  • Cancellation information

By completing the subscription process, you authorize recurring charges in accordance with the subscription selected.

Skybolt may provide renewal reminders or other subscription notices where required by law.

17. Cancellation

You may cancel your Skybolt subscription at any time using the self-service cancellation functionality provided by Skybolt.

Cancellation instructions are also available in the Skybolt Help Center.

Cancellation stops future automatic recurring billing.

Canceling recurring billing does not automatically delete your Skybolt account or talent profile.

If you want your account or profile deleted, you must separately contact Skybolt at:

Skybolt may require reasonable authentication before canceling or deleting an account in order to protect against unauthorized requests.

18. No Refunds

All Skybolt subscription payments are nonrefundable.

Skybolt does not provide:

  • Partial-month refunds
  • Prorated refunds
  • Refunds for unused subscription time
  • Refunds following cancellation
  • Refunds for failure to use the Services

Cancellation prevents future recurring billing but does not create a right to a refund for amounts already paid.

This policy applies to monthly, annual, and other subscription periods unless Skybolt expressly agrees otherwise in writing.

Nothing in this section eliminates any refund right that cannot legally be waived.

19. Price Changes

Skybolt may change subscription pricing.

Price changes will apply as disclosed by Skybolt and subject to applicable law.

Where legally required, Skybolt will provide notice before a price change affecting an automatically renewing subscription takes effect.

20. Payment Failures

Skybolt may restrict, suspend, or terminate paid functionality if:

  • A payment is declined
  • Payment authorization expires
  • A charge is reversed
  • A payment dispute is initiated
  • Amounts owed remain unpaid

Users are responsible for maintaining accurate and current billing information.

21. Communications

Skybolt may communicate with users through:

  • Email
  • SMS or text messaging
  • In-application messages
  • Push or system notifications
  • Support messages

Skybolt currently uses SendGrid for email and Twilio for text messaging.

Communications may include:

  • Account messages
  • Agent communications
  • Casting or submission information
  • Security alerts
  • Billing information
  • Customer support
  • Service notices
  • Legal or policy notices

Some transactional and administrative communications are necessary to provide the Services.

Message and data rates may apply to SMS messages.

22. Changing Agencies

Talent who need to change their associated talent agency may contact Skybolt for assistance.

Skybolt may verify the request before changing the agency relationship associated with an account.

Historical submissions, agency records, casting records, communications, or other information may remain associated with prior activity where reasonably necessary for recordkeeping, security, or the rights of other users.

23. Account Deletion

Cancellation and account deletion are separate actions.

Canceling a subscription stops recurring billing but does not automatically delete the account.

Users may request deletion by contacting:

Skybolt may retain certain information after deletion where reasonably necessary for:

  • Transaction records
  • Legal obligations
  • Security
  • Fraud prevention
  • Dispute resolution
  • Audit records
  • Historical casting or submission records involving other users
  • Backup and disaster recovery

Personal information is otherwise handled as described in the Skybolt Privacy Policy.

24. Privacy

Skybolt's collection and processing of personal information is governed by the Skybolt Privacy Policy, which is incorporated into these Terms.

25. Third-Party Services

Skybolt uses third-party technology and infrastructure providers.

These may include:

  • Google Cloud
  • Firebase
  • Firestore
  • Google Gemini
  • Stripe
  • SendGrid
  • Twilio
  • Intercom
  • Google Analytics

Third-party services may be subject to their own terms and privacy policies.

Skybolt is not responsible for independent third-party websites or services that are outside Skybolt's control.

26. Suspension and Termination

Skybolt may suspend, restrict, or terminate access where we reasonably believe:

  • These Terms have been materially violated
  • Fraud or unlawful activity has occurred
  • An account creates a security risk
  • An account is being used without authorization
  • Payment obligations have not been satisfied
  • Action is necessary to protect another user
  • Action is necessary to protect Skybolt
  • Termination or suspension is legally required

Skybolt may remove content or restrict functionality where reasonably necessary.

27. Service Availability

Skybolt works to maintain reliable Services but does not guarantee uninterrupted availability.

Services may occasionally be unavailable because of:

  • Maintenance
  • Technical failures
  • Internet or telecommunications failures
  • Third-party outages
  • Security incidents
  • Events outside Skybolt's reasonable control

Skybolt may modify or discontinue features from time to time.

28. No Guarantee Regarding Other Users

Skybolt does not guarantee the identity, honesty, qualifications, conduct, or intentions of every user or recipient of professional talent information.

Skybolt does not conduct background checks on every person who may access public professional information or receive talent information through legitimate industry workflows.

Talent, parents, agents, and casting professionals are responsible for exercising reasonable judgment when dealing with other persons.

29. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

SKYBOLT DISCLAIMS WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • TITLE
  • NON-INFRINGEMENT

SKYBOLT DOES NOT WARRANT THAT:

  • THE SERVICES WILL ALWAYS BE AVAILABLE
  • THE SERVICES WILL BE ERROR-FREE
  • ALL INFORMATION PROVIDED BY USERS WILL BE ACCURATE
  • AI-GENERATED OUTPUT WILL BE ACCURATE
  • EVERY USER IS WHO THEY CLAIM TO BE
  • USE OF SKYBOLT WILL RESULT IN PROFESSIONAL OPPORTUNITIES

Nothing in these Terms excludes warranties that cannot legally be excluded.

30. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKYBOLT AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE SERVICES.

THIS INCLUDES LOSS OF:

  • PROFITS
  • REVENUE
  • DATA
  • BUSINESS
  • PROFESSIONAL OPPORTUNITIES
  • GOODWILL

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKYBOLT'S TOTAL LIABILITY ARISING FROM OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF:

  1. THE AMOUNT YOU PAID TO SKYBOLT DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
  2. $100.

This limitation does not apply to liability that cannot legally be limited.

31. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Skybolt and its owners, employees, contractors, and affiliates from third-party claims, losses, liabilities, damages, and reasonable expenses resulting from:

  • Your unlawful use of the Services
  • Your material violation of these Terms
  • Content you upload without appropriate rights
  • Your infringement of another person's rights
  • Information you provide without authority
  • Your unlawful conduct toward another user

This section does not require indemnification where prohibited by law.

32. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

To the extent permitted by applicable law, legal proceedings arising out of or relating to these Terms or the Services must be brought in a state or federal court having jurisdiction in Los Angeles County, California.

Nothing in this section prevents a party from bringing an eligible matter in small claims court or exercising rights that applicable law does not permit these Terms to restrict.

33. Changes to These Terms

Skybolt may update these Terms as the Services or applicable requirements change.

The current Terms will identify the date they were last updated.

If a change materially affects users' rights or obligations, Skybolt will provide additional notice where required by applicable law.

Continued use of Skybolt after updated Terms become effective constitutes acceptance to the extent permitted by law.

34. General Terms

If a provision of these Terms is determined to be unenforceable, the remaining provisions remain in effect.

Skybolt's failure to enforce a provision does not waive our right to enforce it later.

You may not transfer your account or assign these Terms without Skybolt's permission.

Skybolt may assign these Terms in connection with a reorganization, financing, merger, acquisition, or sale of the business or relevant assets.

These Terms, together with the Privacy Policy and any other agreement expressly applicable to a particular Skybolt service, constitute the agreement governing use of the Services.
